Injury Waiver Policy:
I myself, my spouse, my child, and on behalf of our heirs, assigns, personal representatives and next of kin, HERE BY RELEASE AND HOLD HARMLESS (GMA) Gallatin Martial Arts Center Inc, (DBA) GMA Martial Arts Center (DBA) Global Martial Arts Center (GMA) its directors, officers, officials, agents, employees, volunteers, unions organizations, federations other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct classes or academy events. (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property incident to myself, my child’s / children's or families involvement or participation in all activities, including (Martial Art Programs, Fitness Programs, Weight Lifting, Gymnastics, Cardio Programs, After School Programs, Home Pick Up Programs, including After School or Event Transportation. WHETHER ARISING FROM NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. “ I also acknowledge martial arts, self defense and fitness training are a high risk activities that can cause serious injury or death so (CHECK WITH YOUR PHYSICIAN) “Practice at your own risk” Gallatin Martial Arts Center Inc, its directors, officers, officials, agents, employees, volunteers, teachers, organizations, federations other participants, agencies, sponsors, advertisers, and if applicable, owners and lessors of premises; do not pay for any physical or mental injuries or possible death arising from any academy activities. I additionally understand that there are risks in the transportation of a child from school or home to our academy and that there is a possibility of injury or death. I release Gallatin Martial Arts Center, inc and it's drivers and staff from any and all possible legal action. I understand all the physical risks involved in our programs and classes. You must have medical Insurance to train or participate in any activity / program at (GMA) Gallatin Martial Arts Center inc, (DBA) GMA Martial Arts Center, Global Martial Arts USA does not pay for any medical injuries or loss of income due to any form of injuries.
Sickness / Injuries / Flu / Covid / Serious Health Conditions:
Member/Parent/Guardian represents that he/she will not use the facility with any fever, coughing, open cuts, abrasions, open sores, infections, maladies with the potential of harm to others, or otherwise in accordance with public health requirements. The management of Gallatin Martial Arts Center shall have the final determination in this regard.
Photographs / Media / Online
I consent that the photographs, videotapes, and/or motion picture film for which the student or attendee is in/posed- and/or audio recordings made of the student’s voice-may be used by GMA Martial Arts for birthday parties, marketing and advertising purpose. Furthermore, I hereby consent that such photographs, films, and recordings—and the party discs, files, and tapes from which they are made—shall be the property of GMA and they shall have the right to sell to party attendees, duplicate, reproduce such photographs, video, and recordings as they may desire free and clear of any claim whatsoever on my part. ( Exam Day / Event photos are posted for all members to view)
Non - Competition Clause:
I understand that for a period of 5 years after the cancellation or expiration of this agreement the student or signer will refrain from using any proprietary knowledge obtained from the academy without written permission and full authorization from GMA and its academy Grandmaster. You also understand you may not open an academy, teach, recruit members or work within 15 miles of Gallatin Martial Arts or any licensed branch academy. If GMA or any of its agents need to enforce this non-compete policy, you will be responsible for any and all legal fees and fees to cover an injunction.
